Introduction and Overview
JobManch AI (“the Platform”) is a digital product owned and operated by Upquarx Technology Pvt. Ltd., Mumbai, Maharashtra, India. These Terms and Conditions (“Terms”) define the rules and obligations for all users (“you”, “your”) accessing or using the Platform via jobmanch.ai, jobmanch.in, or any related services, including future web applications.
By accessing or using the Platform, creating an account, or engaging with any of our services, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, you must discontinue using the Platform immediately.
To access or use JobManch AI, you must be of legal employment age as defined under the laws of your country. Organizations, recruiters, or companies using the Platform must be legally registered business entities.
Account Management and User Responsibilities
Users are required to register an account using valid information such as name, email address, and other necessary credentials. You agree to provide accurate and up-to-date information and to maintain the security of your login credentials.
You agree not to misuse the Platform or engage in activities such as unauthorized access, data scraping, impersonation, or posting misleading information. JobManch AI may suspend or terminate accounts for violations of these Terms or any applicable laws.
Users are responsible for maintaining confidentiality of account credentials. Any activity occurring under your account will be deemed your responsibility unless proven otherwise.
JobManch AI reserves the right to suspend or delete accounts that remain inactive for a continuous period of one (1) year or engage in fraudulent or abusive activities.
Payments, Subscriptions, and Refunds
JobManch AI operates on a pay-as-you-go subscription model for employers and recruiters. Job seekers can use certain features free of cost, while recruiters and companies may be required to subscribe for premium access.
Payments are securely processed through Razorpay or other authorized payment providers. All users agree to comply with their respective terms and policies during transactions.
All payments are final and non-refundable unless explicitly required by applicable law or a special exception approved by the Company in writing.
In case of subscription termination by the user, access to premium features will continue until the end of the billing cycle and no partial refunds will be issued.
Intellectual Property and Use of Platform
All intellectual property rights in the Platform, including logos, design, software, algorithms, and databases, belong to Upquarx Technology Pvt. Ltd. Unauthorized reproduction or use is strictly prohibited.
When users upload resumes, assessments, or related data, they grant JobManch AI a limited, non-exclusive license to use, process, analyze, and display this information solely for operational and analytical purposes.
Users shall not upload offensive, unlawful, or harmful materials, attempt to reverse engineer the system, or exploit platform vulnerabilities.
JobManch AI utilizes advanced AI models including OpenAI and similar technologies to assist in recruitment and evaluations. While accuracy is prioritized, AI-generated insights or results may not always reflect real-world outcomes. Users should use discretion and human judgment alongside automated evaluations.
Privacy, Data, and Cookies
JobManch AI collects personal and professional data as described in our Privacy Policy. This includes details provided by users during registration and their platform activity data.
We use cookies and similar technologies to enhance platform functionality and analytics. Our WP Consent plugin enables users to manage cookie preferences as per GDPR and DPDP requirements.
Users have the right to request access, correction, or deletion of their personal data. Such requests can be made via info@upquarx.com, subject to verification and applicable law.
Legal Terms, Liability, and Jurisdiction
Upquarx Technology Pvt. Ltd. shall not be liable for any indirect, consequential, or incidental damages resulting from the use or inability to use JobManch AI. Users acknowledge that AI-generated outcomes carry inherent limitations.
Users agree to indemnify and hold harmless Upquarx Technology Pvt. Ltd., its affiliates, employees, and partners from any claims or liabilities arising from their use of the Platform or breach of these Terms.
These Terms shall be governed by the laws of India. All disputes shall fall under the exclusive jurisdiction of the competent courts in Mumbai, Maharashtra.
We may update these Terms periodically. Material changes will be communicated via email or website notice. Continued use after updates constitutes acceptance of the revised Terms.
